The Bill 59 diagnostic process is based primarily on the identification, analysis

and prioritization of psychosocial risks present within companies, in line with the

modernization of the Loi sur la santé et la sécurité du travail (LSST) obligations.

Here are the steps in the process, as required by the CNESST:

Identifying risks

The employer must first identify the risks that threaten employees' psychological health. This includes not only physical risks, but also psychosocial stress factors such as harassment, excessive workload, work organization and interpersonal tensions.

Risk analysis

Once the risks have been identified, they need to be analyzed to determine their severity and potential impact. This step enables us to prioritize the most critical risks and understand the factors that exacerbate them, in order to propose appropriate preventive or corrective measures.

Implementation of preventive measures

Preventive and corrective measures must be tailored to the risks identified. This may include :

  • Training for employees and managers

  • Organizational adjustments (work schedules, task allocation)

  • Updates to internal mental health and safety policies

Monitoring and assessment

The diagnostic process is iterative, with regular follow-ups to ensure that risks are well managed and that the measures put in place are effective. Psychosocial risks must be continually reassessed, and policies adjusted accordingly.

ADDITIONAL OBLIGATIONS

Since 2022, employers have been required to formalize these efforts in a prevention program

specific to their establishment, and to set up health and safety committees, particularly for

companies with more than 20 employees.

This process is crucial to ensure that the company complies with the regulatory requirements of Bill 59.
